EPISODE 29
Jude Albert walks confidently to the witness stand since Omar is testifying for them.
“Mr. Iddrisu, can you tell this court your relationship with the accused, Mr. Curtis Owusu-Mensah.”
OMAR
Curtis and I are like brothers. Our parents are friends and have been with him for as far back as I can remember. We went to the same schools throughout our lives and have always been together.
LAWYER ASOMANING
Good. Do you know the complainant, Ms. Cynthia Osei?
OMAR
Yes, I do. She was in a relationship with Curtis. In fact, they were inseparable then.
LAWYER ASOMANING
Can you tell the court what happened and they had to go their separate ways?
Lawyer Bawuah roars as he gets to his feet.
LAWYER BAWUAH
Objection, your honour. I don’t know where Counsel is going with this.
JUDGE HAGAN
Sustained. Mr. Asomaning, you have to be snappy about your questions. We aint got all day. Just make your point, will you?
LAWYER ASOMANING
Thank you, Your Highness! Mr. Iddrisu, is Curtis still in a relationship with Ms. Osei?”
OMAR
No, they broke up in the final year at the University.”
LAWYER ASOMANING
Do you by any chance know why they broke off?”

No, I don’t. There were rumours of unfaithfulness on her part but Curtis never told us why he broke off with her.
Curtis opens his eyes wide in shock. Omar and Kobby saw him through that painful ordeal. They were a great help in his resolve to finally push that relationship under the carpet and never revisit it ever again. Lawyer Asomaning signals for him to keep his cool.
LAWYER ASOMANING
Were you the one that booked the hotel and purchased the ticket for Ms. Cynthia Osei for the Tamale trip?
OMAR
Yes, I did.
LAWYER ASOMANING
Why was that? You just told us they were not a couple anymore so why in heaven’s name did you send Cynthia on the same plane Curtis was flying and checked her into the same hotel in Tamale?
Omar looks at Curtis who is looking on expectantly and then he turns his gaze to Cynthia who seem to scowl at him.
OMAR
Curtis asked me to. He said he didn’t want his wife to know that he was travelling with Cynthia. He said he has realized he made a mistake by marrying Alicia so he has rekindled his relationship with Cynthia and will eventually leave Alicia and marry her.
Jude Albert is shocked.
That was not the answer he has expected. He has gone over this with Omar so many times. He has changed his statement and he is messing up things for Curtis. Suddenly, Jude is not sure if he should go on or leave it be. He knows he has to play smart or things will surely be messy for Curtis.
LAWYER ASOMANING
Before Curtis supposedly came to you to ask you for the huge favour, have you seen the two of them together. What I mean is, were you aware they had resumed their relationship.
OMAR
Not really
LAWYER ASOMANING
It’s a yes or no, Mr. Iddrisu, nothing else.
OMAR
No
LAWYER ASOMANING
Mr. Iddrisu, if what you are saying is correct, don’t you think Curtis could have arranged for the travel without involving you, since he supposedly didn’t want his wife to know about it?
LAWYER BAWUAH
Objection, your honour, Counsel is leading the witness.
JUDGE HAGAN

LAWYER ASOMANING
The Executive Assistant at Curtis’ office indicated in her statement to this court that you came personally with Ms. Osei to the office to ask for Curtis’s flight and hotel details, is that true or not?
OMAR
Yes, that’s true.
LAWYER ASOMANING
Would you mind telling us why that is? Because I’m sure Curtis might have given you the details already when he asked you to do him that favour.
OMAR
It’s all part of the plan! He asked me to devise a means to get the information from the Secretary. He didn’t want his hand on it and I know why now.
Curtis cries out, shocked to his wits end.
CURTIS
That is a lie and you know it. Why are you doing this, Omar? Why in God’s name are you doing this?
JUDGE HAGAN
Counsel, you need to control your client. I won’t take another outburst from him.
LAWYER ASOMANING
Which plan, if I may ask?
OMAR
The plan to get Cynthia to Tamale with him.
LAWYER ASOMANING
Are you telling this court that Cynthia was forced to go to Tamale? That it was all Curtis’ big idea?
OMAR
No, I didn’t say that. Cynthia was thrilled to go with him. She has always loved him.
LAWYER ASOMANING
Now I’m confused, Mr. Iddrisu. Curtis asks you to discreetly book travel and accommodation for an ex-girlfriend, a girl he wouldn’t talk to you over because you brought her to a ‘boys only sit up’ you and your other friend had come up with just to get Curtis to meet you. Then, you went ahead to convince him to take her back at the same meeting.
Curtis reacted angrily and exchanged words with you over this in a public place because he was very disappointed you would go to that extreme to get him to leave his wife who had just been diagnosed HIV positive. He specifically told you not to meddle in his marriage and told the complainant, Ms. Cynthia Osei to stay clear of him.
You are telling us a few days after this incident Curtis turns around and asks you to do him this favour when he has not picked any of your calls from that night at the club. To make matters worse, you go to his office with Ms. Cynthia on the pretence that you and your friends wanted to surprise Curtis in Tamale with your presence hence needed his flight details for that matter.
Which is which, Mr. Iddrisu? Don’t you think your statements are a bit incoherent?
Omar is quiet for a while.
LAWYER BAWUAH
Objection, your honour! Counsel is leading the witness.
JUDGE HAGAN
Sustained. Counsel, get straight to your point.
LAWYER ASOMANING
I put it to you, Mr. Iddrisu that it was your idea to get Cynthia on that plane to finish what you had intended when you brought her to the club that night. You want to separate Curtis from his wife at all cost because you found out she is HIV positive, is that not it? You got the travel information from the Executive Assistant in Curtis’ office and booked Cynthia on the same flight because she had asked you to.
OMAR
I don’t want him to die. Alicia will infect him if he stays with her. It is in his best interest to leave her. I don’t want him to die.
LAWYER ASOMANING
I have no further questions, your honour.
Lawyer Jude Albert says proudly and takes his seat.
The Judge turns to the counsel for the plaintiff and asks if he will cross examine. Lawyer Bawuah declines and then the Security Person at the Hotel that night is put on the witness stand.
He also lies through his teeth about that night in question. He tells the court that he heard screams and shouts for help from the accused’s hotel room and that drew him there. And then he adds that he knocked on the door for a while before the door opened and that was when he saw the plaintiff in tears. He took her to her room.
Jude Albert is not surprised the security man lied. He has changed his statement frequently and he should have known better not to have forced him to testify. He is sure somehow Cynthia has gotten to him.
LAWYER ASOMANING
Mr. Martey, kindly clarify something for me. You heard screams and shouts for help from the accused’s room that night so as a good citizen and by the onus of your work to protect clients of your employers you rushed to the scene. Now tell me, was the door open or locked when you got to it?

So, your first action at the scene is knock and not just turn the handle to see if it’s locked or not. Anyway, the screaming and shouts for help, did it stop when you knocked?
MARTEY
Yes, I think so.
LAWYER ASOMANING
Please answer yes or no.
MARTEY
Yes.
LAWYER ASOMANING
Who opened the door?
MARTEY
The accused, sir.
LAWYER ASOMANING
Did you hear the rattle of a key or door clicking open before the door opened?
MARTEY
No.
LAWYER ASOMANING
How many times did you knock before the door opened?
MARTEY
Once, sir.
LAWYER ASOMANING
So, the one who is so bent on having his way with Ms. Osei gets time to walk to the door and open it for you at just a knock. What was he wearing, if I may ask?
MARTEY
I’m not really sure, I didn’t really pay attention because the lady came out immediately he opened the door and started crying.
LAWYER ASOMANING
Did you get a chance to see what the miss was wearing?
MARTEY
Sure, I couldn’t have missed that. She was in a mini night dress of sorts made of lace and one could see everything of hers in it. Her round breasts stood out and her beautiful buttocks was visible too.
LAWYER ASOMANING
Did you see any sign of a struggle, broken items etc when the door was opened or later when the accused checked out of the hotel?
MARTEY
No, sir. I didn’t see or hear anything about breakages.
LAWYER ASOMANING
What did the miss say when she came out of the room?
MARTEY
Can’t really remember, but she seemed angry. I heard ‘spurn me’, and ‘you will pay for this’, something like that but I didn’t really understand what she meant.
LAWYER ASOMANING
Did she look like someone who had just been sexually mishandled?
LAWYER BAWUAH
Objection, your honour. Witness is not an expert in these matters.
JUDGE HAGAN
Sustained
LAWYER ASOMANING
Let me rephrase the question. Did Miss Osei’s appearance suggest that she had been hurt?
MARTEY
Didn’t really see anything like that outwardly. She could be hurting inside, I guess.
LAWYER ASOMANING
Tell us what you did when the Miss came out of the room.
MARTEY
I led her to her room at the other wing of the hotel.
LAWYER ASOMANING
That will be all, your honour.
Jude Albert walks to his seat.
The prosecuting counsel forgoes cross examination. The Judge pulls the curtain on proceedings and announces that the session is adjourned till the next day for closing remarks and final report from the jury.
